Trade Marks

A trade mark is a sign that acts as a badge of origin and identifies products or services as being from one particular trader. Trade marks form part of a business’ brand identity, allowing it to stand out from competitors in the market place.

 

Trade marks are traditionally words, phrases and logos, but now can also include smells, shapes, colours, sounds and animations.

Registered trade marks grant the owner an exclusive right to use, and authorise others to use, the trade mark in connection with the goods or services described in the registration for an initial period of 10 years. Registered trade mark rights can be renewed indefinitely.

While a trade mark owner can assert rights in both unregistered and registered trade marks, registered trade marks are enforced under an Act which provides a legal framework to object to unauthorised use.

A strong registered trade mark helps build and maintain brand identity, consumer trust, and market reputation.
